We reserve the right to modify or review the details of this Policy without prior notice, and the revised Policy will be in effect from the day of uploading. Therefore, Users are requested to visit the website and review the Policy periodically.

Hiatt Hardware UK Ltd operates Hiatt Hardware Website, and as a user of this website (referred to as "you/your"), you fully agree with these Terms and Conditions even if you do not register with us. If you do not agree with these Terms and Conditions, do not use this website.

The dimensions displayed on our website are approximate, but we try our best to make sure they are as accurate as possible.

The product descriptions shown on our website are correct to the best of our knowledge. However, if you find a mistake in the description, we would be grateful if you informed us of this error so we can amend it with immediate effect.

The product images displayed on our website are, to our understanding, a fair reflection of the physical products. However, we cannot guarantee that the appearance and colours of the products shown are a replica of the appearance and colours of the product itself.

The category images on our website are for display purposes only, and we do not necessarily sell the products that feature within them.

All images used are for illustrative purposes only. Despite every effort to provide accurate images of each product's colour and design, actual colours and design may vary slightly, due to different device screen settings, the lighting in the installation location, slight differences in product finishes over time and other factors. Hiatt Hardware will not accept responsibility for any colours that are not factory faults.

In purchasing from Hiatt Hardware, you agree to accept the small risk that there will be a slight variation between the actual colour and the representation on our website. In addition, please be aware that colours and textured finishes often vary between manufacturers; for example, slightly different shades of ‘Antique Brass, different degrees of shininess, and different looks and feel for natural materials.

If you are not the end-user, you confirm that you have authority to bind any person or company on behalf of whom you are using our website.

Not all products that we sell are available online.

All products on our website are sold for domestic use only; if you purchase these products for business use, you will not be entitled to the benefit of the warranties which usually apply.

We reserve the right to adjust prices, offers and specifications of goods before you order.

 

Login And Registration

We will use personal information disclosed to Us by a User for one or more of the following purposes: (a) to help Us in creating content that is relevant to the User; (b) to collect a database of all the Personal Information collected from User.

When you register with us, you will be required to create an account password, which should be unique to this website to keep your personal information safe. You should not share your password with any other person or with multiple networks, and it must be kept secure at all times.

If you believe that any of your user details have been compromised and/or accessed by a third party, please get in touch with us immediately.

All personal details you provide during your registration must be accurate, true and current. Furthermore, you must notify us of any changes by contacting us via email or calling us on 0800 0590 950 Monday – Friday between 9 am and 5 pm.

You confirm that you are not impersonating any other person or entity or using a false name or a name that you are not authorised to use.

You are not allowed to use the www.hiatt-hardware.com site to make any false or fraudulent orders.

We are entitled to provide the Police and/or any other regulatory or government authority investigating suspected illegal activities with your Personal Information and/or User.

 

Order Process

When you receive an Order Confirmation email, this means that your order has been placed and is waiting to be reviewed and accepted. However, we reserve the right to cancel the order for any reason, in which case we will issue a full refund.

We will contact you via email if we are unable to accept your order for any reason.

The ownership title of goods and, therefore, the risk of loss and damage passes on to you once delivery is made, provided the goods are paid for.

You will be contacted by us via phone or email if, unfortunately, the goods you ordered are out of stock. If the goods ordered are due to come back in stock within a reasonable time, we will give you the option of either waiting until the goods are back in stock or cancelling your order.

Suppose you order more than one item, and one of those items is out of stock. In that case, we will contact you and give you the option of waiting for that particular item to come back in stock, cancelling the item out of stock, or cancelling your entire order.

You have the opportunity to check and correct any input errors up to the point where the order is placed.

You agree and understand that placing an order with us creates a contract between you and www.hiatt-hardware.com.

We reserve the right to adjust prices, offers and specs of goods before your order has been processed but will inform you and ask you to confirm your agreement to these changes before despatch.

 

Payment

You can pay for your online purchase using PayPal, Visa, MasterCard, Diners, JCB Credit and UPI. 

Payment is officially taken after your order has been security checked just before despatch.

Ensure that the expiry date on the card you use to make payment is after the anticipated despatch date. If the expiry date on your card falls within the expected despatch time, we will be unable to take the required funds.

By placing an order through our website, you confirm that the credit/debit card or PayPal account being used for payment is yours. All orders are subject to payment security checks with PayPal or your card issuer. Failure to pass these checks will result in us cancelling your order, and we are not obliged to inform you of the reason for the failure. However, we will inform you that your order has been cancelled.

Our website uses a payment authentication service called 3-D Secure and is used to combat fraudulent online transactions. It allows the card issuer to fully authenticate online transactions using Verified by Visa or MasterCard SecureCode (depending on the type of card being used), which requests the User to enter the correct password to authorise the payment from their card.

If you bypass the Verified by Visa or MasterCard SecureCode, your order will be cancelled as your payment must be 3-D secured to pass our payment security checks.

 

Discount Codes

All promotional codes are subject to terms and conditions. Any promotional codes must be applied at the time of purchase by entering the code into the Discount Code Box in the shopping cart.

If the code has been applied successfully, we will recalculate the value of the items in your cart to account for your promotion. You will see the code included in the payment review section before clicking proceed. If the code is invalid or entered incorrectly, an error will appear at the top of the page. Promotional codes can only be used once and cannot be used with other offers unless stated otherwise. You must add all discount codes BEFORE placing the order, as we cannot apply any discounts once the order has gone through, so please contact us via email if there are any issues using codes.

 

Cancellations

Under the Consumer Contracts Regulation, you have a right to cancel your order for any item purchased on this website before dispatch and receive a full refund. This does not apply to items personalised or made to your specification.

In certain circumstances, before your order has been dispatched, we may be able to cancel your order. Please contact us by telephone as soon as possible after placing your order, and Customer Service will advise if cancellation is available. Please note that we cannot combine orders, change the size, edit your billing and shipping details, or add pieces to an existing order once it has been placed.

 

Standard Returns Policy

If you wish to return an item for change of mind, you need to notify Hiatt Hardware within 30 calendar days from the day after delivery by contacting our customer support team at websales@hiatt-hardware.com.

When returning an item to us, it is your responsibility to ensure that the item is packaged correctly in original packaging with all the components, including any promotional items received (including gifts or discounted additional products) and carefully so that no damage is caused to the article. Failure to do so may result in your return being refused and/or any refund due being reduced. In addition, if you are returning goods due to a change of mind, then they must be returned in a re-saleable condition failing which we may not accept refunds or exchanges.

You must return the goods within 30 calendar days at your costs subject to our customer service team's authorisation. Where returns have been completed without prior notification and approval from the Customer Service Team, refunds will not be provided. The burden of proof is that of the consumer to prove an item has been returned and ensure it is returned safely.

The customer shall pay for returns unless the order is damaged upon receipt or your order has missing products.

Missing, Damaged, Faulty Goods or Incomplete Orders

Goods supplied shall be of satisfactory quality, fit for purpose and as described. Goods should not be faulty or damaged, or incomplete when you receive them.

You have a clear right to reject goods that are unsatisfactory quality, unfit for purpose or not as described, and get a full refund. You have 30 days to return a faulty product from taking ownership of a product (this could be the date of purchase or the date it was delivered to you - whichever is later) to claim a refund if it is faulty. After 30 days, we request an opportunity to repair or replace goods before you can claim a refund. In the first instance, write to our customer services department objectively on websales@hiatt-hardware.com, so you have a written record as evidence.

If you want to return your faulty goods for a refund, a repair or replacement, we shall arrange and pay for the collection at no cost to you as a responsible retailer.

 

Product Issues

If a product you have ordered develops a fault within 30 days from the date of purchase or the date it was delivered to you- whichever is later, you have the right to receive a full refund.

If you are outside 30 days, right to reject, but within six months from the date of purchase or the date it was delivered to you- whichever is later, we ask for an opportunity to repair or replace faulty goods which are of unsatisfactory quality, unfit for purpose or not as described.

Please email our Web Customer Service Team at websales@hiatt-hardware.com to investigate the matter. In order to allow this investigation to take place, we will require your order number and photographs of your concerns. If we find that the product is faulty due to no fault of your own, we will arrange a collection and a replacement or refund depending on the situation.

If we find that the product has developed a concern due to misuse, wear and tear, or accidental damage, we are under no obligation to replace the item or issue you with a refund.

If a defect develops after the first six months, the burden is on you to prove that the product was faulty at the time the goods were delivered to you as goods are duly inspected prior to dispatch. In practice, this may require some form of an expert report, opinion or evidence of similar problems or defects across the product range.

Hiatt Hardware reserve the right to make a deduction from any refund for fair use after the first six months of ownership if an attempt at a repair or replacement is unsuccessful.

You have up to six years to take a claim to the small claims court for faulty goods in England, Wales and Northern Ireland and five years in Scotland.

This doesn't mean that a product has to last six years - just that you have this length of time in which to make a claim if you refuse to repair or replace a faulty product.

Refunds

If a refund is required due to a product being returned to us, we will only issue that refund once we have received the returned product.

Refunds will be processed within 30 calendar days of receipt of the returned item(s). The refund payment will be made to the original payment method used when placing the original order.

Your Statutory Rights

Under the Consumer Contracts Regulations, you have a right to cancel your order for any item purchased on this website and receive a full refund. However, this does not apply to items that are personalised or made to your specification.

To cancel, you can email us by filling out a contact us form or call us on 0800 0590 950 (Monday – Friday, 9 am – 5 pm) within 30 calendar days of delivery of your item(s) quoting your order number. You must take reasonable care of the item(s) and must not use them.

Liability And Indemnity

The products which the Hiatt Hardware website sells are intended for domestic purposes only. We are not liable for the fitness of goods used for business purposes, nor are we responsible in any circumstances for the cost or any losses arising from the use of the item in the event of a claim for breach of warranty or condition.

If we are held responsible for any loss or damage regarding a product, our aggregate liability shall be limited to a sum equal to the amount paid by you for that product.

We will not be held responsible for any additional costs incurred when purchasing from our website. 

We strongly advise you book your joiner once you have received and checked the goods.

We try our utmost to keep your details and payment secure, but unless we are negligent, we are not responsible for any unauthorised access to any details provided by you.

We are not liable for any delay or failure to deliver or perform any obligation that is specified in these terms and conditions when the reason for delay or failure is due to circumstances beyond our reasonable control.

You are not allowed to assign or sub-contract any of your rights or obligations under these terms and conditions.

Nothing in these terms and conditions excludes or limits liability for death or personal injury caused by negligence, fraudulent misrepresentation, or any other liability which may not be limited or excluded under appropriate law.

We try to keep the website content accurate, up to date and error-free but cannot guarantee that errors will be corrected or that the server on which the site is hosted is free of bugs or viruses. Therefore, we will not be held responsible for any material or content lost when uploading or transmitting through our website.

We try to ensure that the website is available at all times. However, you may occasionally be restricted access to www.hiatt-hardware.com to allow for repairs, maintenance or the introduction of new facilities or services. Still, we will try our best to get the website up and running as soon as we can.

If you breach these terms and conditions, Hiatt Hardware UK Ltd reserves the right within a reasonable period to pursue its rights and remedies against you, but if it waives the right to do so, it may take action in any future situation where you are in breach.

We reserve the right to suspend or cancel your account with us at any time if you breach any of your obligations under these terms and conditions or for any other reason that we see fit.

If we waive a right in these terms and conditions, it will not necessarily be waived in the event of any future breach of that or any other provision.

If a section of these terms and conditions is held to be invalid or unenforceable by the applicable authority or does not conform with the appropriate law, it does not affect the validity or enforceability of any other sections of these terms and conditions.

Materials on the site are only appropriate and available for use in locations within the United Kingdom, and accessing the site from territories where its contents are illegal or unlawful is strictly prohibited. If you access the www.hiatt-hardware.com site from locations outside the UK where its contents are illegal or unlawful, then you do so at your own risk and are solely responsible for the consequences.

The laws of England shall govern these terms and conditions, and any disagreement between us will be resolved solely in the courts of England, and the only language offered is English.

 

Unsolicited Goods

In case you receive any unsolicited goods without payment in your consignment delivery from us, we request you to urgently contact us in writing on websales@hiatt-hardware.com so that we can arrange collection. Meanwhile, the risk of damage to or loss of the Goods passes to you at the time of delivery. Therefore, it will be your duty to keep the goods safely as the Title of the goods does not belong to you unless paid for in full. We firmly ask that you contact us within 48 hours of the delivery and support our customer services team in arranging a collection at our own expense within 7 days of your notification.

Failing to respond or simply ignoring receipt of Unsolicited goods or passing goods to the third party without prior authorisation shall result in a Sales Invoice generated, payable immediately enforceable under these Terms and Conditions. Hiatt Hardware (UK) Ltd. reserves all its legal rights.

 

Intellectual Property

You may retrieve and display the contents of the www.hiatt-hardware.com site on a computer screen. You may use, download or make one hard copy of an extract from www.hiatt-hardware.com site or store such content in electronic form on disk for your personal, non-commercial use only, on the condition that all copyright, trademark and proprietary notices contained in the original material from the website are kept intact.
