Terms and Conditions
1. THE PROMOTER
The promoter is: Hiatt Hardware, 106 Elkington St, Birmingham B6 4SL
2. THE PROMOTION
2.1 The title of the promotion is the Hiatt Hardware 'WIN: Dewalt Bushless Combi Drill'
2.2 Within 7 working days of the promotion end date (defined below), the Promoter will select promotion applications from among those submitted via social media, which satisfy the eligibility criteria (defined below). 1 random applicant (“Applicant”) will be selected, which will receive a Dewalt DCD796M2-GB 18V Brushless Combi Drill 2 x 4.0Ah
3. HOW TO ENTER
3.1 The promotion will start on 30th July 2020, and will run for a period which will end at 23.59 UK time on 13th August 2020 (“Application Period”). Applications must be submitted before the end of the Application Period (as appropriate), in order to qualify for entry.
3.2 The Applicant should follow the Hiatt Hardware Facebook Page (https://www.facebook.com/hiatthardware/) or Hiatt Hardware Instagram Page (https://www.instagram.com/hiatthardware/), and then tag a friend in the comments of the Facebook () or Instagram Post ()
3.3 The Promoter will not accept:
(a) responsibility for promotion entries that are not received, lost, damaged or delayed in transmission, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, network, server, computer hardware or software failure of any kind; or
(b) proof of transmission or submission of a photo as proof of receipt of entry to the promotion.
The random selection will be final.
4. ELIGIBILITY
4.1 The promotion is only open to residents of the UK aged 18 years or over, except:
(a) employees of the Promoter or its holding or subsidiary companies;
(b) employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the promotion or its administration; or
(c) members of the immediate families or households of (a) and (b) above.
4.2 In entering the promotion, you confirm that you are eligible to do so and eligible to claim any prize you may be awarded. The Promoter may require you to provide proof that you are eligible to enter the promotion.
4.3 The Promoter will not accept promotion entries that are:
(a) automatically generated by a computer or software;
(b) completed by third parties or in bulk;
(c) illegible, have been altered, reconstructed, forged or tampered with;
(d) photocopies and not originals; or
(e) incomplete.
4.4 There is no limit to the number of entries to the promotion per person and per business per Application Period. Entries on behalf of another person will not be accepted and joint submissions are not allowed.
4.5 The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the promotion.
4.6 Use of a false name or social post will result in disqualification.
5. THE PRIZE
5.1 During the Promotion Period, the one 'prize' will be the DeWalt DCD796M2-GB 18V Brushless Combi Drill 2 x 4.0Ah
5.2 There is no cash alternative for the prize
5.3 We are in no way affiliated with Dewalt
6. SELECTION OF APPLICANTS
6.1 The decision of the randomly selected winners by the Promoter is final and no correspondence or discussion will be entered into.
6.2 The Promoter will e-mail or direct message the Applicant as soon as practicable (and in any event within [7] working days) after the end of the Application Period, by reaching out directly through the social media channel entered on.
7. CLAIMING AND DELIVERING THE PRIZE
7.1 The prize will be delivered within 7 working days after the announcement of the successful Applicants.
7.2 The prize may not be claimed by a third party on an Applicant's behalf.
7.3 The Promoter does not accept any responsibility if an Applicant fails to take up the promotion prize.
7.4 The prize will be delivered to the address of the Applicant's choosing
8. LIMITATION OF LIABILITY
Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the Applicant or accept any liability for any loss, damage, personal injury or death occurring as a result of accepting the prize or entering the promotion, except where it is caused by the negligence of the Promoter. Your statutory rights are not affected.
9. OWNERSHIP OF PROMOTION ENTRIES AND INTELLECTUAL PROPERTY RIGHTS
9.1 The Promoter does not claim any rights of ownership in your promotion entry.
9.2 By submitting your promotion entry, you agree to waive all moral rights in and to your promotion entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.
9.3 You agree that the Promoter may, but is not required to, make details of any successful Applicant's entry available on its website hiatt-hardware.com.com and on its social media pages, and in any other media, whether now known or invented in the future, in connection with any publicity relating to the promotion.
9.4 You agree to grant the Promoter a non-exclusive, worldwide, irrevocable license, for the full period of any intellectual property rights in the promotion entry, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-license the promotion entry for such purposes.
10. DATA PROTECTION
10.1 The Promoter will only process your personal information as set out in Hiatt Hardware's Privacy Policy.
10.2 The Promoter will process your personal data included in the Application Form:
(a) for the purposes of running, judging and administering the promotion, which is necessary for the purposes of compliance with our obligations under the contract between us; and
(b) (if you are a successful Applicant), for the purposes of reasonable promotion and marketing of the Promoter relating to this promotion, and for the purposes of promoting your business, both of which are necessary for the purposes of legitimate interests pursued by the Promoter.
11. SUCCESSFUL APPLICANT'S FUTURE PARTICIPATION IN HIATT HARDWARE'S MARKETING ACTIVITIES
You agree that if selected as a successful Applicant, you will agree to any reasonable requests Hiatt Hardware may make that you provide comments about Hiatt Hardware to the press.
12. GENERAL
12.1 If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the promotion.
12.2 The Promoter reserves the right to hold void, suspend, cancel, or amend the promotion where it becomes necessary to do so.
12.3 These terms and conditions shall be governed by English law, and the parties submit to the jurisdiction of the courts of England and Wales.
